Terms and conditions of the online store available at: https://mrowson.pl administered by MrówSon 3D Remigiusz Leszczyński, hereinafter referred to as the Seller, conducting business activity at ul. Długa 16, 85-034, email: kontakt@mrowson.pl, govern the rules for sales contracts concluded through the online store, including their types, the rights and obligations of Customers and the Seller, the procedure for withdrawing from the contract and the complaint procedure.

§ 1 Definitions

Online shop – online shop available at https://mrowson.pl

Seller – MrówSon 3D Remigiusz Leszczyński, sole trader, with registered office at ul. Długa 16, 85-034, NIP (Tax Identification Number) 5542435553, REGON (National Business Registry Number) 340886664, e-mail: kontakt@mrowson.pl

Customer – a natural person, legal person or organisational unit without legal personality, to which the law grants legal capacity, entering into a contract with the Seller.

Consumer – a natural person, in accordance with Article 22^1 of the Act of 23 April 1964 – Civil Code, who performs a legal transaction with the Seller not directly related to their business or professional activity.

Service – electronic services provided by the Seller to the Customer via the online shop.

Distance contract – means a contract concluded between the Seller and the Consumer as part of an organised distance contract system, without the need for the physical presence of both parties to the contract, concluded by means of one or more means of distance communication.

Sales Agreement – an agreement for the sale of products available in the Online Shop, concluded between the Customer and the Seller.

Goods – a product, movable item that the Customer purchases from the Seller via the Online Shop.

Order form – an electronic service, a form available in the Online Shop enabling the Customer to make a purchase, including selecting the Goods, specifying the delivery method and payment method.

Order – a declaration of will made by the Customer via the Online Shop, aimed at directly concluding a Sales Agreement, specifying the type and quantity of Goods, the method of delivery, the form of payment and the Customer’s details necessary for the performance of the agreement.

Working day – days from Monday to Friday, excluding public holidays in Poland.

§ 2 General provisions

The Seller undertakes to provide services to the Customer in accordance with applicable law and the rules set out in these Terms and Conditions, as well as in accordance with the principles of good social coexistence.

The Seller declares that it complies with the rules on the protection of Customers’ personal data, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as the GDPR.

The Customer agrees to the collection, storage and processing of personal data by the Seller solely for purposes related to the fulfilment of orders in the Online Shop. Detailed rules regarding the collection, processing and protection of personal data by the Seller are set out in the “Privacy Policy” available in the Online Shop.

The Customer undertakes to use the Online Shop and the services offered by the Seller in accordance with applicable law, these Terms and Conditions, and generally accepted principles of social coexistence.

The Seller guarantees that the Goods offered in the Online Shop are:

a) new and free from defects,

b) safe for users,

c) consistent with the description provided in the Online Store,

d) legally placed on the Polish market.

The manufacturer’s warranty does not exclude or limit the Customer’s rights under the warranty for physical and legal defects of the product purchased from the Seller.

The seller fulfils orders within Poland.

Information about products available in the Online Store, including prices, does not constitute an offer within the meaning of the Civil Code, but is an invitation to conclude a contract, in accordance with Article 71 of the Civil Code.

All prices listed in the Online Shop are in Polish zlotys (PLN). These prices do not include delivery costs.

Delivery costs depend on the selected shipping method and type of shipment. The full delivery cost is clearly indicated to the Customer before completing the order and accepting the Terms and Conditions, as well as in the order confirmation sent by the Seller.

§ 3 Sales agreement

In order to conclude a valid and binding Sales Agreement via the Online Shop, the Customer shall follow these steps:

a) selects the Goods, specifying their quantity and characteristics, using the “add to basket” option,

b) fills in the order form, providing the details necessary for the performance of the contract, i.e.: first name, surname, delivery address, telephone number, e-mail address and, if applicable, VAT invoice details, and selects the delivery and payment method.

The Seller accepts orders via the Order Form available in the Online Shop, which is active 24 hours a day, seven days a week.

After the Customer has made their selection and placed their order, the Online Shop shall immediately confirm receipt of the order by sending an automatically generated e-mail to the address provided by the Customer when placing the order.

After receiving the order, the Seller shall send the Customer an order confirmation by e-mail to the e-mail address provided, which shall constitute the conclusion of the Sales Agreement.

The order confirmation contains all essential elements of the contract, including the quantity and type of Goods ordered, their specifications (in the case of Goods with individual characteristics specified by the Customer), the total amount to be paid, including delivery costs and any discounts.

The Seller shall keep the Customer informed about the status of the order via electronic communication.

§ 4 Order fulfilment and delivery

Orders are fulfilled by the Seller in the order in which they are received, in accordance with the provisions set out in these Terms and Conditions.

The time required to process an order is 2 to 4 working days, including preparing the order for shipment, which involves picking, packing and handing over the shipment to the selected courier company. Orders are handed over for delivery on working days.

In the event of circumstances preventing the order from being fulfilled within the agreed time frame, the Seller shall immediately inform the Customer in order to set a new delivery date or find another solution regarding the delivery of the ordered products.

The delivery of the ordered Goods is carried out by Poczta Polska (Polish Post) or selected courier companies, according to the Customer’s preferences.

The seller guarantees that all parcels are properly secured and packaged to avoid damage during transport.

Information about available delivery options and related costs is described in detail on the Store’s website in the “Delivery costs” section.

When placing an order and in the order confirmation, the Customer is informed about the total delivery costs.

The Customer has the right to cancel or modify the order until they receive confirmation of acceptance of the order for processing, by contacting the Seller via email.

Upon receipt of the shipment, the Customer or an authorised person should carefully check the condition of the packaging for any damage or signs of tampering, and the contents for completeness. If any irregularities are found, a damage report should be drawn up in the presence of the delivery person and the Seller should be notified immediately. This procedure is intended to facilitate the determination of the causes and responsibility for the damage. The lack of a report drawn up in the presence of the delivery person does not affect the Customer’s right to lodge a complaint in accordance with the Terms and Conditions.

Live insects are delivered exclusively by Pocztex – Express 24 courier service.

§ 5 Payments

The seller offers customers the following payment methods:

a) traditional transfer to the Seller’s bank account: 38 1140 2004 0000 3402 7058 1274, maintained by mBank,

b) BLIK payment to the phone number: 662709119

c) Secure online payments with tPay

The Customer is obliged to pay for the order within 3 calendar days from the moment of receiving a message confirming the acceptance of the order for execution by the Seller, containing the total cost of the order, including delivery costs. Failure to make the payment within the specified time limit will result in the cancellation of the sales contract.

Once the payment has been credited to the Seller’s account, for the payment methods listed in points a) and b), the order is forwarded for processing.

§ 6 Right of withdrawal

In accordance with applicable law, including Article 27 of the Consumer Rights Act of 30 May 2014, a Customer who is a consumer has the right to withdraw from a distance contract without giving any reason within 14 calendar days from the date of receipt of the Goods.

This right may be exercised by the Customer by sending an unequivocal statement of withdrawal from the contract to the Seller’s registered office or by e-mail to: kontakt@mrowson.pl.

If the right of withdrawal is exercised, the contract shall be deemed not to have been concluded and the Customer shall be obliged to return the Goods to the Seller no later than 14 days from the date on which the Customer informed the Seller of their decision to withdraw from the contract. The product should be returned intact.

The Seller undertakes to immediately, no later than within 14 days of receiving the Customer’s statement of withdrawal from the contract, refund all payments made by the Customer, including delivery costs, using the same form of payment as used by the Customer, unless the Customer agrees to a different solution. The Seller does not charge any fees for refunding payments.

The Customer shall not have the right to withdraw from the contract in exceptional circumstances specified in the Act, including, but not limited to, when:

a) the purchase concerns a product made to individual order or tailored to the specific needs of the Customer,

b) the purchase concerns sealed audio or visual recordings or computer software if the packaging has been opened after delivery,

c) the contract concerns the supply of newspapers, magazines or periodicals, with the exception of subscription contracts,

d) the contract concerns the supply of digital content which is not recorded on a tangible medium, if the performance of the service began with the Customer’s express consent before the expiry of the withdrawal period.

The direct costs of returning the Goods shall be borne by the Customer.

§ 7 Warranty and complaints regarding Goods

§ 8 Security of personal data

W celu złożenia reklamacji, Towar wadliwy, wraz z opisem stwierdzonej wady, należy przesłać na adres działalności Sprzedawcy z dopiskiem “Reklamacja”.

Sprzedawca zobowiązuje się do rozpatrzenia wszelkich reklamacji nie później niż w ciągu 14 dni od daty ich otrzymania.

Sprzedawca informuje, że nie udziela dodatkowych gwarancji na sprzedawane Towary, chyba że są one objęte gwarancją producenta lub dystrybutora. W takich przypadkach zakres i warunki gwarancji określone są w dokumencie gwarancyjnym dostarczonym wraz z Towarem.

§ 8 Bezpieczeństwo danych osobowych

The personal data controller, which is the Seller, constantly monitors potential risks to ensure the secure processing of Customers’ personal data. Ensuring data security includes restricted access to data – only expressly authorised persons have access, and only to the extent necessary to perform their duties. The controller undertakes to keep accurate records of all operations on personal data, ensuring that it is processed only by authorised persons.

Furthermore, the Seller, as the Data Controller, takes all necessary measures to ensure that all its subcontractors and business partners apply adequate data protection measures whenever they process personal data on its behalf. This assurance includes the implementation of appropriate security procedures and monitoring of their compliance in order to protect personal data against unauthorised access or other forms of unlawful processing.

§ 9 Final provisions

In matters not covered by these Terms and Conditions, the applicable provisions of Polish law shall apply, including in particular the Civil Code and the Act of 30 May 2014 on consumer rights.

The Terms and Conditions shall enter into force on the date of their publication on the Shop’s website, i.e. on the date of launch of the Online Shop.

The Seller reserves the right to amend the Terms and Conditions. Any amendments to the Terms and Conditions shall become effective on the date specified by the Seller, not less than 7 days from the date of their publication on the Store’s website. Orders placed before the amendments to the Terms and Conditions come into force shall be processed in accordance with the provisions of the Terms and Conditions in force on the date of placing the order.
